1. Eligibility and Authority

You represent that:

• If you are using the Services on behalf of a business or other legal entity, you have the authority to bind that entity to these Terms.

2. Description of Services

MyEstimator.pro LLC provides a software-as-a-service platform that enables businesses to create custom estimators, collect and manage lead information, generate pricing ranges, analyze estimator performance, and manage related customer interactions.

The Services may evolve over time. MyEstimator.pro LLC reserves the right to modify, suspend, or discontinue any part of the Services at any time.

3. Account Registration and Security

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information;
• Maintain and promptly update your account information;
• Safeguard your login credentials;
• Accept responsibility for all activities conducted through your account; and
• Notify MyEstimator.pro LLC immediately of any unauthorized use or security breach.

MyEstimator.pro LLC is not responsible for losses caused by unauthorized access resulting from your failure to secure your credentials.

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation;
• Infringe or misappropriate intellectual property or other rights;
• Upload or transmit unlawful, harmful, defamatory, obscene, or otherwise objectionable content;
• Interfere with or disrupt the integrity, security, or performance of the Services;
• Attempt to gain unauthorized access to systems, accounts, or data;
• Harvest or collect data without authorization;
• Engage in fraudulent, deceptive, or misleading practices;
• Send spam or unsolicited communications through the platform; or
• Use the Services for competitive intelligence, reverse engineering, or benchmarking without written consent.

MyEstimator.pro LLC reserves the right to investigate violations and take appropriate action, including suspension or termination.

5. Subscriptions, Fees, and Payments

Certain features require a paid subscription.

By subscribing, you agree to:

• Pay all applicable fees for your selected plan;
• Provide valid payment information and authorize recurring charges;
• Acknowledge that subscription fees are billed in advance and automatically renew unless canceled; and
• Understand that fees are non-refundable except as required by law.

MyEstimator.pro LLC may change pricing with reasonable notice. Continued use of the Services after a pricing change constitutes acceptance of the updated fees.

6. Intellectual Property Rights

Company IP

The Services, including all software, designs, interfaces, text, graphics, and trademarks, are owned by MyEstimator.pro LLC and protected by applicable intellectual property laws.

No rights are granted to you except as expressly set forth in these Terms.

Customer Content

You retain ownership of content you create or upload ("Customer Content"). You grant MyEstimator.pro LLC a limited, non-exclusive, royalty-free license to host, store, process, and display Customer Content solely to provide and improve the Services.

7. User Content and Responsibility

You are solely responsible for Customer Content and represent that:

• You have all necessary rights and permissions;
• Your content does not violate third-party rights; and
• Your use of the Services complies with applicable laws, including data protection laws.

MyEstimator.pro LLC does not monitor or validate Customer Content and is not responsible for its accuracy or legality.

8. Data Processing and Compliance

When End Users submit information through estimators you create, MyEstimator.pro LLC processes such data on your behalf.

You are solely responsible for:

• Determining the data collected;
• Providing required notices to End Users;
• Obtaining lawful consent or legal basis; and
• Complying with applicable privacy and data protection laws.

Our processing of such data is governed by our Privacy Policy and, where applicable, a Data Processing Addendum.

9. Service Availability and Support

The Services are provided on an "as available" basis. MyEstimator.pro LLC does not guarantee uninterrupted or error-free operation.

We may suspend access for maintenance, updates, security issues, or circumstances beyond our control. Reasonable efforts will be made to provide advance notice for planned downtime.

10. Termination

MyEstimator.pro LLC may suspend or terminate your access immediately, with or without notice, if:

• You breach these Terms;
• Subscription fees are unpaid;
• Fraudulent, unlawful, or abusive activity is suspected; or
• Continued use poses legal, security, or operational risk.

Upon termination:

• Your right to use the Services ceases immediately; and
• You may export your data prior to termination where permitted by the platform.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYESTIMATOR.PRO LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MYESTIMATOR.PRO LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES; AND
• OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO MYESTIMATOR.PRO LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless MyEstimator.pro LLC and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of:

• Your use of the Services;
• Your Customer Content;
• Your violation of these Terms; or
• Your violation of applicable law or third-party rights.

14. Governing Law and Venue

These Terms are governed by the laws of the United States and the State in which MyEstimator.pro LLC is organized, without regard to conflict of law principles.

Any dispute shall be brought exclusively in the state or federal courts having jurisdiction over such matters.

15. Changes to These Terms

MyEstimator.pro LLC may update these Terms at any time. Material changes will be posted on our website with an updated "Last Updated" date. Continued use of the Services constitutes acceptance of the revised Terms.
